-​It is observed that the Interactive Dialogue on the oral progress report of the Special Rapporteur on the situation of human rights in Myanmar was held on 6 July 2023 at the ongoing 53rd session of the Human Rights Council.

 

-​Myanmar wishes to highlight the misconduct of the Special Rapporteur upon his oral presentation and the issuance of the so-called conference room paper entitled “The Billion Dollar Death Trade:  International Arms Networks that Enable Human Rights Violations in Myanmar” (A/HRC/53/CRP.2) as a subsidiary document before the Council. The Special Rapporteur has been given ill-suited mandate by the EU and western sponsors to produce limitless conference room papers with attempts to discredit the Government.

 

-​The paper focuses on unilateral sanctions imposed by some western countries on Myanmar and calls for imposing harder ones for alleging committing international crimes. It should be noted that the Special Rapporteur has been making such recommendations to the countries as an attempt to perform as human rights champions while covering up their own atrocities, extensive violations of international law and committing heinous crimes prevented in international human rights and humanitarian laws in different parts of the world.

 

-​It is surprised to learn how the Special Rapporteur narrowly interprets the revenue of state-owned enterprises which greatly contributes to state’s expenditure on public services including health, education and social welfare of the people of Myanmar. His call for imposing sanctions on such enterprises simply means to hurt the people and violate the right to development of Myanmar.

 

-​The Special Rapporteur further glorifies the acts of CRPH, NUG and PDF terrorists which claimed the lives of 6,091 innocent civilians including 202 young children, 80 teachers, 74 members of the Sangha, 825 village and ward administrators and 251 other public services personnel, 17 medical service personnel and members of political parties. ​

 

– It is disturbing to see the Special Rapporteur toured the countries in the region and lobbied for the NUG and PDF terrorist groups while he has been anxiously dictating sovereign countries how to isolate Myanmar bilaterally and multilaterally within the framework of regional organizations and beyond. There is no doubt that such appalling acts of the Special Rapporteur significantly degrade the work of the Human Rights Council. Myanmar reminds that the Special Rapporteur should oblige the Article 3 (f) of the Code of Conduct for Special Procedures Mandate-holders which is to neither seek nor accept instructions from any Government, individual, governmental or non-governmental organization or pressure group whatsoever.

 

-​On the matter of repatriation of displaced persons from Rakhine State, the Governments of Myanmar and Bangladesh have been continuing their cooperation to realize the pilot project. Myanmar deplores the Press Release by the Special Rapporteur on 8 June 2023 which discouraged the efforts of the countries to repatriate the displaced persons.

 

– Myanmar, as a country-concerned, has repeatedly and firmly stated its clear position on the Special Rapporteur that Myanmar never recognizes and accepts the mandate and any product of the Special Rapporteur on the situation of human rights in Myanmar.

 

– Myanmar is of the view that duplicated mandates created by the Human Rights Council are just a waste of time and resources and counterproductive. Therefore, Myanmar reiterates its firm objection on holding one-sided country-specific ID at the Human Rights Council and the politicized, imbalanced and deceitful oral presentation of the Special Rapporteur.
